The three major steps in a criminal proceeding as we find in the criminal procedural law are inquiry, investigation and trial. Inquiry is done by the magistrate wherein he ascertains whether any primafacie case is there or not for which cognizance is to be taken. Investigation is done by the police as per the direction of the magistrate where he tries to collect evidences for the purposes of proving the guilt of the accused persons. After completion of the investigation , the police submits report to the court if evidences have been found as well as not found. Then starts the ultimate or the final stage of the criminal proceeding i.e. trial. In trial either the guilt of the accused person will be proved based on the evidences that have been collected by the police during investigation or it will not be proved. If the guilt is proved the accused is convicted and hence penalised and if the guilt is not proved then the accused would be acquitted. Therefore it may be said that trial ends either in conviction or acquittal.
